Please read these terms carefully before using the Cortex AI platform or any Cyvalent services.
1. Acceptance of Terms
By accessing or using the Cyvalent website, the Cortex AI platform, or any related services (collectively, the "Services"), you agree to be bound by these Terms of Use. If you do not agree to these terms, you must not access or use the Services.
We reserve the right to modify these terms at any time. Your continued use of the Services following any changes constitutes your acceptance of the new terms.
2. Intellectual Property
The Services, including all content, features, and functionality (such as information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof), are owned by Cyvalent, its licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Services without explicit written consent.
3. User Conduct
You agree to use the Services only for lawful purposes and in accordance with these Terms of Use. You agree not to use the Services:
- In any way that violates any applicable federal, state, local, or international law or regulation.
- To engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Services.
- To attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Services, the server on which the Services are stored, or any server, computer, or database connected to the Services.
- To deploy any automated systems (e.g., "bots," "spiders") to access the Services in a manner that sends more request messages to the Cyvalent servers than a human can reasonably produce in the same period.
4. Limitation of Liability
In no event will Cyvalent, its affiliates, or their licensors, service providers, employees, agents, officers, or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, the Services.
This includes any direct, indirect, special, incidental, consequential, or punitive damages, including but not limited to, personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, and whether caused by tort (including negligence), breach of contract, or otherwise, even if foreseeable.
5. Governing Law
All matters relating to the Services and these Terms of Use, and any dispute or claim arising therefrom or related thereto, shall be governed by and construed in accordance with the internal laws of the jurisdiction in which Cyvalent is headquartered, without giving effect to any choice or conflict of law provision or rule.
